About Subminimum Wages
Section 14(c) of the Fair Labor Standards Act (FLSA) authorizes employers to pay subminimum wages to workers with disabilities that impair their productivity for the work they perform. Only employers who hold a 14 (c) Certificate may pay subminimum wages. The U.S. Department of Labor, Wage and Hour Division requires that all workers who are paid subminimum wages, regardless of their age, receive regular career counseling and information about self-advocacy, self-determination and peer mentoring training opportunities in their local area.
The 14(c) employers coordinate with specially trained Career Counseling Information and Referral Services (CCIR) providers to ensure that participants receive the required services. VR provides the funding for the courses.
The 14(c) employers are responsible for ensuring that subminimum wage participants:
- Register and participate in the required training
- Take required training: every six months during the first year of employment and annually, thereafter.
- Coordinate with CCIR providers to schedule the courses in order to meet the required timeframes.
- Employers must maintain a copy of the following documents.
- Copy of all rosters verifying participation
- Copy of certificate of completion of course
